If a person dies and someone else is at fault for the death, a claim can be asserted on behalf of the deceased person's surviving spouse and next of kin.  A trustee is usually appointed to represent the surviving spouse and next of kin. In addition, a judge usually must approve the way the proceeds of any settlement are divided among the surviving spouse and next of kin.
